STANDARD TERMS AND CONDITIONS

GodZone Internet Services (herein after referred to as GodZone) is a division of AGRE Enterprises Limited. Any and all references in this agreement to GodZone are deemed to apply to and include AGRE Enterprises Limited.

Please read this document carefully before applying for a GodZone Account. By applying for and being given an Account, you are agreeing to be bound by the terms and conditions of this agreement and disclaimer of warranty. Please do not continue with the application process if you do not agree with the terms of this agreement.

All account holders will be notified of any change in the terms and conditions by electronic mail sent to the address associated with the Account.

Your Responsibilities as an Account Holder

GodZone when creating an Account will assign an initial password. You are responsible for changing your password frequently to ensure the security of your account. In the event of any unauthorised access to an account, GodZone must be promptly notified in writing or by telephone. You will be responsible for all costs incurred until such time as GodZone has been notified.

An Account is approved on the basis that it is solely for the use of the applicant. Services associated with an account cannot be on-sold or used by a third party.

An Account cannot be assigned or transferred to another party without the express permission of GodZone.

You agree to accept all costs incurred by your account, as stated in the description of the each service, and to pay such costs either by the date due or in advance, as required by the type of service.

Notices, warnings, alerts, invoices and statements from GodZone will be sent by means of electronic mail to the address associated with each Account. It is the responsibility of the Account Holder to ensure this electronic mail address is kept up to date and that mail sent to it will be read and if necessary acted upon in a timely manner.

Tax Invoice/Statements are sent by electronic mail each month for services and/or goods supplied and are payable by the 20th of the month in which they are issued. You may wish to keep your account in credit. If so, any such payments will only be receipted. A Tax Invoice/Statement will continue to be sent each month showing the current balance.

At the start of each month, any account with:

• an outstanding balance of less then $50 will have received a warning stating that the account is overdue.
• an outstanding balance exceeding $50, or an outstanding balance of 30 days will have all services associated with the account suspended until payment has been received.
• an outstanding balance exceeding $50, or an outstanding balance of 60 days will be disabled and will probably be closed. All services associated with the account will be deleted.

We reserve the right to refer any unpaid account to a Debt Collection Agency. Once the matter has been referred to them, you will become liable for all collection fees including the Agency fees and commission we would have to pay for this service.

Services

You are expressly forbidden from tampering with or trying to bypass system security or traffic measurement. Any attempt at computer 'hacking' will result in immediate termination of your account.

Electronic Mail

If we are hosting your domain for email, you specifically agree not to use our servers as a means of sending unsolicited electronic mail (spam). Such mailings are deemed to include:- advertising, chain letters, pyramid schemes etc, but do not include the legitimate use of mailing lists.

Web Hosting

For each web site, you accept and assume all responsibility, including legal liability for the content of your web site.

You are expressly prohibited from publishing on a Web Site hosted by GodZone any unlawful, threatening, libelous, obscene, profane, sexually offensive, or objectionable information of any kind, including encouraging the use of controlled substances that would constitute a criminal offence or give rise to any civil liability or otherwise violate any local, national or international law.

You specifically agree not to upload or reproduce in any way information protected by copyright without obtaining the permission of the copyright holder.

Internet Domains

If specific Terms and Conditions exist for a Country Top Level Domain e.g. .nz or a generic Top Level Domain e.g. .com, you will be asked to agree to them during the registration or transfer process.

GodZone Internet Services Rights and Responsibilities

GodZone may suspend or terminate an Account without notice in the following cases:

• it is determined that information supplied during the application process is untrue or intended to deceive
• use of the account violates a term or condition of this agreement
• reasonable efforts to meet the costs incurred by the account are not being made.
• an outstanding balance has existed for 90 days.

GodZone may change or add services at any time without prior notice.

GodZone will collect and store only sufficient information about or pertaining to an Account Holder to enable us to operate our ministry. Any information held will not be made available to a 3rd party under any circumstances, without written authorisation from the Account Holder.

Limitation of Liability

GodZone does not guarantee that the services provided will meet an Account Holder's requirements or that the operation of these services will be uninterrupted and error-free.

Under no circumstances, including negligence, shall GodZone be liable for any incidental, special or consequential damages that result from the use of or inability to use a service or that result from mistakes, omissions, interruptions, deletion of files, errors, defects, delays in operation or transmission, or any failure of performance whether or not caused by events beyond GodZone's reasonable control, including but not limited to acts of God, communication line failures, theft, destruction or unauthorised access to GodZone's records, programs or services.

Disclaimer of Warranties

You expressly acknowledge and agree that the use of GodZone is at your sole risk. GodZone provide services 'as is' and without warranty of any kind, either expressed or implied including but not limited to the warranties of the merchantability and fitness for a particular purpose. No oral advice or written information given by GodZone shall create a warranty nor shall you rely on any such information or advice.

Indemnity

You agree to indemnify and hold GodZone harmless from any claims and expenses, including reasonable legal fees related to your violation of this agreement.

Miscellaneous

This agreement shall be governed by and construed in accordance with the laws of New Zealand. This agreement constitutes the entire agreement between the parties with respect to an account with GodZone.

ADDENDUM 1. - PRIVACY POLICY

Introduction

GodZone is committed to protecting your privacy as either an Account Holder or an Internet user. GodZone recognises its responsibility to keep confidential at all times any information which GodZone acquires from an Account Holder or an Internet user via either GodZone's secure payment facility. GodZone protects personal information (at a minimum) to the Payment Card Industry Data Security Standard. Please note however, GodZone's responsibility is limited to protection by GodZone of information which GodZone obtains.

Collection of Information

To enable GodZone to provide its secure payment facility, it will typically acquire information which may include a Credit/Debit card holder's name, card number (with expiry date), cvv security code, contact and/or billing address(es).

Use and Disclosure of Information

GodZone uses the information, in the case of its secure payment facility, to obtain authorisation of a transaction from the issuing bank of the credit/debit card and GodZone's own bank and to process the payment.

Security

GodZone is commited to data security. GodZone uses a variety of technologies and procedures to help protect personal information from unauthorised access, use or disclosure. When GodZone transmits sensitive information (such as credit/debit card details), GodZone protects it through the use of encryption such as the Transport Layer Security (TLS) protocols. GodZone is a level 4 certified PCI-DSS compliant merchant.

PCI-DSS

"PCI-DSS, the Payment Card Industry Data Security Standard is a set of security requirements relating to the protection of card holder data. The standard is governed by the PCI Security Standards Council, an organisation put together by most of the major card schemes VISA, MasterCard, American Express, JCB and Discover. It is relevant for any entity that stores or transmits sensitive card holder data, that being generally things like the PAN (card number), card security code, track data, PIN block. The current version of the standard is Version 2.0. Preceding PCI-DSS the card schemes had their own standards. The VISA Account information Security (AIS) standard formed the basis to most of the PCI-DSS requirements."
